REQUEST RELEASE OF FUNDS

On or after May 29, 2023 the City of Waldo will submit a request to the Arkansas Economic Development Commission for the release of ACEDP funds under Title I of the Housing and Community Development Act of 1974 amended, to undertake the Waldo Wastewater Improvement Project. The proposed project will include replacing sewer main and manholes.
The activities proposed project is categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at Southwest Arkansas Planning & Development District, P.O. Box 767, Magnolia, AR 71754 and can be examined between the hours of 8 a.m. and 4 p.m.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the Southwest Arkansas Planning & Development District, P.O. Box 767, Magnolia, AR 71754. All comments received by May 28, 2023; will be considered by the Southwest Arkansas Planning & Development District prior to authorizing submission of a request for release of funds.
RELEASE OF FUNDS
The City of Waldo certifies to Arkansas Economic Development Commission that its Chief Executive Officer, as Certifying Officer in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. Arkansas Economic Development Commission’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Waldo to use HUD program funds.
OBJECTIONS TO RELEASE OF FUNDS
Arkansas Economic Development Commission will accept objections to its release of fund and the City of Waldo’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases:
(a) The certification was not executed by the Certifying Officer of the City of Waldo;
(b) The City of Waldo has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58;
(c) The grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by Arkansas Economic Development Commission; or
(d) Another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the Grants Management Division, Arkansas Economic Development Commission, One Commerce Way, Suite 601, Little Rock, Arkansas 72202. Potential objectors should contact Grants Management Division, Arkansas Economic Development Commission to verify the actual last day of the objection period.
Objections to the release of funds on bases other than those stated above will not be considered. No objection received after June 14, 2023.
