Bid 22-27, Construction ? Industrial Drive Extension
The City of Fayetteville, AR (owner) is accepting formal, sealed bids from properly qualified, experienced, and licensed
contractors for the extension of Industrial Drive. The Contract includes, but is not limited to, the construction of approximately 2,800 linear feet of two-lane roadway from S Industrial Drive to S City Lake Road including demolition, removal and reconstruction of an existing concrete cul-de-sac and associated earthwork, curb and gutter, sidewalk
drainage, and miscellaneous related items. All questions during the bidding process shall be addressed to Amanda Beilfuss,
Sr. Purchasing Agent, at abeilfuss@fayetteville-ar.gov .
A non-mandatory Pre-Bid meeting will be held on Thursday, September 29, 2022 at 2:00 PM local time, via Zoom.
Information regarding the pre-bid meeting is available on the project page on the City’s electronic bidding platform. All
interested parties are encouraged to attend.
Bidding documents, plans, plan holders, and addenda shall be obtained at the City of Fayetteville Purchasing Division’s
electronic bidding platform at www.fayetteville-ar.gov/bids . All bidsshall be received by Thursday, October 13, 2022 before
2:00 PM, local time utilizing the electronic bidding software or by submitting a sealed bid to the address below. All bids shall
be received prior to the bid deadline. Submitting a bid electronically is strongly encouraged. A public bid opening will be
conducted shortly after the deadline at City Hall and livestreamed at https://www.youtube.com/user/cityoffayettevillear .
Late or misdirected bids shall not be accepted. The City of Fayetteville shall not be responsible for lost or misdirected bids,
or failure of bidder’s technical equipment.

Each bid exceeding $50,000 shall be accompanied by a cashier’s check from a bank doing business in the State of Arkansas or a corporate bid bond in an amount not less than five (5) percent of the amount bid. In the event a bidder opts to submit
a cashier’s check for a bid bond, the actual physical cashier’s check shall be delivered to the City prior to the deadline. A
one hundred percent (100%) performance and payment bond is required with the contract awarded. A State of Arkansas
Contractor’s License is not required at time of bid; however, an application for licensure shall be required at time of bid and
an approved contractor’s license shall be required before execution of contract.
Pursuant to Arkansas Code Annotated §22-9-203 The City of Fayetteville encourages all qualified small, minority and women
business enterprises to bid on and receive contracts for goods, services, and construction. Also, City of Fayetteville
encourages all general contractorsto subcontract portions of their contract to qualified small, minority and women business
enterprises.
The City of Fayetteville reserves the right to waive irregularities, reject bids, and postpone the award of any Contract for a
period which shall not exceed beyond ninety (90) days from the bid opening date.
The City hereby notifies all bidders that this contract is subject to the Code of Federal Regulations, Appendix II, Part 200,Contract Provisions for Non-Federal Entity Contracts under Federal Awards applies to this contract and includes but is not limited to termination for cause and for convenience, Equal Employment Opportunity, Davis-Bacon Act, Copeland Anti-
Kickback Act, Contract Work Hours and Safety Standards Act, Clean Air Act, Debarment and Suspension regulations,
conditions under the Byrd Anti?Lobbying Amendment, applicable labor laws, non?discrimination provisions, wage rate laws, the Fair Labor Standards Act of 1938, and other federal laws as defined in the bid documents and any grant agreements between the City of Fayetteville and Grant Administrator. The Work Hours Act of 1962 and Title VI of the Civil Rights Act of 1964 also apply. Bidders are hereby notified of the NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL EMPLOYMENT OPPORTUNITY (EXECUTIVE ORDER 11246).
All qualified applicants will receive consideration for employment without regard to race, color, religion, sex, sexual
orientation, gender identity, or national origin.
The City of Fayetteville, Arkansas hereby notifies all bidders that this contract is subject to applicable labor laws, non-discrimination provisions, wage rate laws and other federal laws including the Fair Labor Standards Acts of 1938. The Work Hours Act of 1962 and Title IV of the Civil Rights Act of 1964 also apply.
Registration and good standing in the System for Award Management (SAM) will be required prior to contract execution.
