This Invitation to Bid (ITB) has been issued by Central Arkansas Water (CAW) to obtain pricing and a contract for chemicals for the Water Production Department.
This contract shall be a firm fixed price contract. In case of default by the bidder, CAW may procure the commodities or services from other sources and may deduct from any monies due, or that may thereafter become due to the bidder, the difference between the price named in the contract or purchase order and actual thereof to CAW. Prices paid by CAW shall be considered the prevailing market price at the time such purchase is made. Periods of performance may be extended if the facts as to the cause of the delay justify such an extension in the opinion of the Purchasing Manager. The term of this Agreement shall begin January 1, 2024, thru December 31, 2024, and may be renewed for three (3) optional one (1) year terms provided the extension is agreed to by CAW and the Contractor.
All charges must be included on the Official Bid Price Sheet and must include all associated cost for the items and/or services being bid. CAW shall not be obligated to pay any costs not identified on the Official Bid Price Sheet. Any cost not identified by the successful vendor but subsequently incurred to achieve requirements shall be borne by the vendor.

B. The Official Bid Price Sheet is provided as a separate excel spreadsheet posted on the CAW website with this Bid Solicitation document.

C. Bid pricing must be valid for 60 days following bid opening.

D. Failure to complete and submit the Official Bid Price Sheet shall result in disqualification.

E. All bid pricing must be in United States dollars and cents.

F. The Official Bid Price Sheet may be reproduced as needed.

2.1 SCOPE OF WORK
A. Vendor shall be responsible for providing the required chemicals per the stated specifications below.

B. Vendor must meet or exceed all requirements and specifications as set forth in this solicitation. CAW shall have the right to amend specifications and requirements, to add or remove specifications, to add or remove service locations, and to add or remove any services offered by the vendor under the scope of this contract, based on revisions in federal, State, and/or local regulations, or as determined to be in the best interest of CAW. Vendor and CAW shall come to a written agreement regarding negotiated cost for such changes.

C. CAW shall have the right to assess damages which shall be deducted from the payment for goods. At the sole discretion of CAW, damages may be assessed based on vendor's failure to meet the requirements of this contract.
