PROJECT LABOR AGREEMENTS (PLA'S) SYNOPSIS:



Fort Worth District Corps of Engineers is soliciting comments on the potential use of PLA's at:



U.S. Army Engineer Corps Fort Worth District

The Corps of Engineers, Fort Worth District is soliciting comments from potential offerors addressing the potential use of PLA's for large scale construction projects.



The market survey is for the B200 Hangar repair / renovation / abatement at Ebbing NGB, Fort Smith Arkansas. A separate solicitation will be issued in FY 2024 for the construction contract award in Fiscal Year 2024.



THIS IS A PROJECT LABOR AGREEMENT SURVEY ONLY. THIS IS NOT A REQUEST FOR PROPOSAL, REQUEST FOR QUOTE, OR INVITATION FOR BID. THERE WILL NOT BE A SOLICITATION, SPECIFICATIONS, OR DRAWINGS AVAILABLE AT THIS TIME.



Background/Scope Summary:



The scope of this project is for a design – bid – build contract for the renovation, repair and abatement of Building 200, an approximately 61,000 SF hanger. Work will consist of: updating to current codes and standards to include ADA compliance, Roof repair, abate known asbestos, lead paint, and mastic, conversion of the existing PFOS/PFOA fire system to a water deluge system, and repair security systems to current requirements.



Magnitude of Construction: Between $25,000,000 and $100,000,000.



In Accordance With (I.A.W.) Executive Order (E.O.) 14063 the use of PLA’s is MANDATORY for large scale projects over $35,000,000 unless one of the following exceptions in OMB Memorandum M-24-06 exists and is approved by the Senior Procurement Executive:




  1. Requiring a PLA on the project would not advance the Federal Governments interests in achieving economy and efficiency in federal procurement. This shall be based on the following factors:

    1. The project is of short duration and lacks operational complexity.

    2. The project will involve only one craft or trade.

    3. The project will involve specialized construction work that is available from only a limited number of contractors or subcontractors.

    4. The agency’s need for the project is of such an unusual and compelling urgency that a PLA would be impracticable.



  2. Market research indicates that requiring a PLA on the project would substantially reduce the number of potential offerors to such a degree that adequate competition at a fair and reasonable price could not be achieved. (See FAR 10.002(b)(1) and 36.104). A likely reduction in the number of potential offerors is not, by itself, sufficient to except a contract from coverage under this authority unless it is coupled with the finding that the reduction would not allow for adequate competition at a fair and reasonable price. Contracting officers shall consider current market conditions and the extent to which price fluctuations may be attributable to factors other than the requirement for a PLA (e.g., costs of labor or materials, supply chain costs). Agencies may rely on price analysis conducted on recent competitive proposals for construction projects of a similar size and scope.

  3. Requiring a PLA on the project would otherwise be inconsistent with federal statutes, regulations, Executive orders, or Presidential memoranda.

PLA Survey Submittal Requirements:



Question 1: Do you have knowledge that a PLA has been used in the local area on projects of this kind? If so, please provide supporting documentation.



Question 2: Are you aware of skilled labor shortages in the area for those crafts that will be needed to complete the referenced project? If so, please elaborate and provide supporting documentation where possible.



Question 3: Are you aware of time sensitive issues/scheduling requirements that would affect the rate at which the referenced project should be completed? If so, please elaborate and provide supporting documentation where possible.



Question 4: Identify specific reasons why or how you believe a PLA would advance the Federal Governments interest in achieving economy and efficiency in federal procurement.



Question 5: Identify specific reasons why you do not believe a PLA would advance the Federal Governments interest in achieving economy and efficiency in federal procurement.



Question 6: Identify any additional information you believe should be considered on the use of a PLA on the referenced project.



Question 7: Identify any additional information you believe should be considered on the non-use of a PLA on the referenced project.



Question 8: Would a PLA significantly increase cost to this project, and do you have an estimated percentage?



We are requesting that industry respond to this Request For Information to provide the Government with support and documentation not just the eight questions above. If you believe any of the exemptions and additional market research requirements listed above would be justified provide documentation and support not to exceed 20 pages. Please ensure you provide any support you believe would assist the Government with making their determination.
